Terms & Conditions
1. General Terms and Acceptance
1.1. Agreement: These Terms and Conditions (T&Cs) govern the sale and installation of all solar, battery storage, EV charging, heat pump, air conditioning, and related services (the “Services”) provided by Prime Solar Energy Pty Ltd (ABN [Insert ABN Here]) (“PSE,” “We,” “Us”) to the customer (“Client,” “You”).
1.2. Acceptance: By accepting a quotation, paying a deposit, or otherwise engaging PSE for the provision of goods or services, you agree to be bound by these T&Cs. These T&Cs supersede any prior agreements or understandings.
1.3. Governing Law: This agreement is governed by the laws of the Australian Capital Territory (ACT) and New South Wales (NSW), where our offices are located, and the courts of those jurisdictions shall have exclusive jurisdiction.
2. Quotations, Pricing, and Payment
2.1. Validity: All written quotations are valid for 30 days from the date of issue unless otherwise specified. PSE reserves the right to amend pricing after this period.
2.2. Best Price Guarantee: Where PSE offers a Best Price Guarantee, it is subject to the condition that the competitor’s quote must be for the identical system (Tier 1 panels, identical inverter, battery model/size, all balance of system components, and equivalent warranties) and the competing retailer must also be a CEC Approved Retailer operating in the same service area.
2.3. Deposits: A non-refundable deposit (as specified in the quote) is required to secure the price, reserve equipment, and confirm the installation date.
2.4. Payment Schedule: Full payment of the remaining balance is due immediately upon the completion of the installation and commissioning of the system, prior to handover. Title to the goods does not pass to the Client until full payment has been received.
2.5. Late Payment: PSE reserves the right to charge interest on overdue amounts at a rate of 10% per annum, calculated daily, until the outstanding balance is paid in full.
2.6. Rebates and Incentives (STCs/Government Grants):
The quoted price assumes that the Client is eligible for and assigns the benefit of the Small-scale Technology Certificates (STCs) or other applicable government rebates to PSE.
If the Client is ineligible for or refuses to assign these benefits, the Client must notify PSE immediately and the quoted price will be increased by the full value of the unassigned benefit.
PSE is not responsible for any changes, cancellations, or delays to government incentive programs after the quote acceptance date.
3. Installation Services
3.1. Client Obligations & Access:
The Client must provide safe, unhindered access to the property, the roof, and the main switchboard on the agreed installation date.
The Client must ensure the installation site complies with all necessary safety and structural requirements.
3.2. Hidden Defects: The Client acknowledges that the quoted price does not cover rectification of unexpected site conditions (e.g., hidden asbestos, structural decay, wiring faults, or buried services) found during the installation. PSE will stop work, notify the Client, and provide a separate quote for remedial work. Installation will not proceed until this remedial work is approved and paid for.
3.3. Workmanship: All installation work is performed by our qualified, CEC-accredited installation team or our licensed, supervised subcontractors, in compliance with Australian Standards.
3.4. System Performance: PSE provides estimated performance figures based on industry standard software and historical weather data. Actual system performance may vary due to factors outside PSE’s control, including weather, shading, dust accumulation, and grid voltage fluctuations. PSE does not guarantee the estimated electricity generation.
4. Products, Warranties, and Maintenance
4.1. Manufacturer Warranty (Product/Performance): All major components (panels, inverters, batteries, heat pumps, etc.) are covered by the original manufacturer’s warranty. PSE will assist the Client in lodging claims but is not responsible for the speed or outcome of the manufacturer’s warranty process.
4.2. Workmanship Warranty: PSE provides a 5-year Workmanship Warranty on the installation itself, covering defects arising from the installation methods used. This does not cover damage caused by external factors (e.g., weather, pests, or misuse).
4.3. Exclusions: Warranties do not cover:
Damage caused by natural disasters, accidents, or electrical surges.
Damage caused by non-PSE service technicians or unqualified personnel.
Routine maintenance tasks (e.g., panel cleaning).
4.4. Maintenance Services: Where PSE provides solar system maintenance or cleaning, the scope of work and associated fees will be specified in a separate agreement.
5. Termination and Liability
5.1. Client Cancellation: If the Client cancels the agreement after paying the deposit but before installation commences, the deposit is non-refundable. If materials have been ordered or bespoke design work has been completed, the Client will be responsible for covering all documented costs incurred by PSE up to the point of cancellation.
5.2. PSE Termination: PSE may terminate this agreement if: (a) the Client fails to make payments as required; (b) the site is deemed unsafe or structurally unsound; or (c) the Client breaches any other material term of this agreement.
5.3. Limitation of Liability: To the maximum extent permitted by law, PSE’s total liability for any claim arising out of or in connection with this agreement is limited to the total amount paid by the Client to PSE under this agreement. PSE shall not be liable for any indirect, incidental, or consequential losses (including loss of profits or loss of electricity savings).
6. Privacy
PSE collects and uses personal information only for the purpose of providing Services and complying with relevant regulatory obligations (e.g., STC applications). Our collection, storage, and handling of your data are governed by our separate Privacy Policy, available on our website.
